The Commission clarifies that disbursement to NPC-SPUG should not exceed the amount of P1.34 Billion. As to the interest earnings of the respective STFs, it is clarified that the same should be considered as part of the STFs that may be used to fund the amount authorized to be disbursed to NPC-SPUG or as an excess amount to be retained with the STF if the required amount has already been disbursed.

NPC's motion for extension dated June 23, 2004 reasonable, is granted. Accordingly, NPC is hereby given ten (10) days from June 24, 2004 or until July 2, 2004 within which to submit said comment.

Relative to the Motion for Clarification filed by PSALM, petitioner,NPC-SPUG is given ten (10) days from receipt within which to submit, if it so desires, its comment on the said motion.

Compliance with the Order dated Dec. 20, 2002 of the Commission directing NPC-SPUG to submit: a. Detailed criteria to determine potential future power projects; and b. NPC Board approval of the revised MEP.

Prayed to the Hon. Commission that the comment of NPC-SPUG on PSALM's Motion for Clarification be NOTED and CONSIDERED. It is likewise prayed that PSALM be directed to continuously release/disburse UC-ME funds to NPC-SPUG on top of the P1.34 Billion already reimbursed to it pending the approval of the Hon. Commission of the 2004 UC-ME.

A total amount of P0.0373 per kWh is APPROVED for withdrawal from the Special Trust Fund (STF) managed by PSALM as its share from the UC-ME effective on the following billing cycles: a. June 26-July 25, 2003 for TRANSCO; and b. July 2003 for DUs. TRANSCO and DUs are directed to collect the UC-ME in the amount of P0.0373 per kWh and remit the same to PSALM on or before the 15th day of the succeeding month.

Motion for clarification whether PSALM should continue to disburse UC-ME to NPC-SPUG in excess of the estimated levy/subsidy requirement of P1.34 Billion and whether PSALM is authorized to disburse the corresponding interest income earnings of the respective STFs to the beneficiaries even without a subsequent order from the Hon. Commission.

Prayed to the Hon. Commission to SET ASIDE its DECISION dated June 26, 2003 and to : 1. allow SPUG to have flexibility in the utilization of UC-ME considering its mandate to implement the MEDP responsive to the needs and constraints of missionary electrification; 2. authorize NPC-SPUG to re-prioritize its CAPEX and its OPEX to the extent possible, for CY 2003; and 3. give NPC-SPUG the flexibilty to reallocate available UC-ME funds among the revised priority activities/projects for CY 2003.

Prayed to the Hon. Commission that NPC-SPUG be given another period of at least ten (10) days from June 24, 2004 or until July 2, 2004 to file its comment to PSALM's Motion for Clarification dated June 9, 2004.
